Perhaps...it would be up to the CO, I would think, to decide if he would get informal or formal punishment for possessing the child porn. Apparently he was not drummed out after the first outbreak of weirdness. That alone says some things about the CO/Powers That Be who had to make the decision about what to do next...either they were covering their six or were oblivious to the signs that this particular Marine was a few rounds shy of a full clip... Is not once sufficient? Diesel, Just like in the civilian world, once charged and awaiting trail military members are not normally confined, sort of like being out on bail. He probably continued living in his same quarters, perhaps not even restricted to base, having the same access to the internet, etc. A few years ago I came across some historical info concerning the draftees inducted as part of "McNamara's 500000," a lowering of standards during the Johnson administration. None of the statistics were very suprising, a lot of administrative and disciplinary discharges. They had trouble coping with the repetative and simple routines of basic training, following the herd so to speak. Sooner or later they would run afoul of military justice, usually once the training staff was exhuasted and frustrated with dealing with them. The inability of these draftees to even comprehend the outline of the process, what role the JAG (the prosecuter) played versus the defense counsel (their lawyer), how the pretrial Article 31 investigation actually led to the charges being filed was the saddest aspect. One of the interviewees, I think it was a basic military training company commanders described it as," Guys who would struggle with the rules for checkers, being expected to compete in a bridge tournament." As I read the article, the first occasion was when he was a child (adolescent) living in the group home. The problem is, if that and other deficiencies were known, why was he ever recruited and inducted in the first place? Ironbar's reply to you goes some way towards answering that question. Especially during wartime, when manpower problems are multiplied, the military can find a place even for morons and are probably more than willing to look the other way for a relatively minor infraction such as the possession of child pornography. It was there that he was caught twice with child pornography. He left the base without authorization and was discovered hanging out in the section of Camp Pendleton where he once attended the Young Marines. Definitely says twice : ) It is interesting that it was recorded as an attraction to child porn when he was at a facility in his pre-marine years - what does that mean? In other words, he was attracted to child pornography. Sounds like he must have been caught with some, which means he obtained it by fair means or foul. Again, it seems to be a case where the "needs of the service" outweigh what is right, logical or even in the service's long-term best interest. Kind of reminds me of those situations where a serial rapist/killer is apprehended at last and his neighbors' comments are often of the "But he was such a nice, polite young man" variety.
