    If there's anything I've learned from game development, it's that there is no such thing as bug free. Patches are just the reality of iteration. Most games these days ship with day 0 patches - in the old days the "gold disc" build would be achieved and the game would go into production, and maybe you then start to work on a patch. These days you cut off a build to ship at the production date, but then immediately start working on a day 0 patch to be downloaded on release, to fix as many other bugs as possible. Even then, you are always "shipping" bugs during bug triage - just like medical triage. Things that break the game are fixed first, things that block the player often are fixed next, things that look ugly are fixed last, and things that are stupid but don't do any of the above are shipped and tucked in the backlog to *maybe* be fixed in the future.
    To give you an idea, one of the last games I worked on shipped with 3,000 bugs - but only one A bug that crashed the game if a user idled in a certain boss encounter for something like 2 days - that was fixed shortly after it was found in the wild.

    Speaking of VG "human wave" attacks, I have read that this is really a reported perception, not a tactic.

    That is, first-hand accounts sometimes report a "human wave" attack, but the argument is that what has in fact happened is that successive assault waves have become tangled up and clumped together due to poor planning and/or poor execution during an attack.
    We all know that a frontal attack involves, well, getting up and moving forward. But I haven't found a historian yet who cites anyone ordering human wave attacks - not even the Russians, whom I always had assumed had launched these sort of attacks, thanks to media representations of it.

    For instance, during the Normandy landings and in the Pacific you see some instances of individuals or small units charging unsuppressed machinegun positions, eliminating them, but being killed in the process. This is the sort of thing that happened to larger units.

    For instance, in Beevor's book Ardennes 44 he describes an American machinegun crew holding off an SS unit all day, noting that the Germans continually mounted charges straight ahead. This was not a "human wave", but a failure to locate and suppress the enemy base of fire before advancing - they were trying to get away with movement without the fire.

    Similarly, at Cassino, we can imagine what would have happened if the Commonwealth didn't have artillery support, and if the first wave was pinned down crossing open ground. Subsequent assault waves would pile up, and unit leaders would perhaps get men moving forward under fire to avoid remaining in the kill zone.

    So, a "human wave" attack is really nonsensical as a concept, something that commanders do not order - rather it is advancing under fire, with the perception that a "human wave" attack has occurred when the defenders are overrun or are able to defeat a large attack that wasn't properly supported.

    So the answer to your confidence in a debate about knowledge is off the table then eh.

    In it there are, of course, no claims about shipment dates for individual products, but there is a clear no return policy - this is the third time I'll quote it: 

    NO REFUND POLICY
    Battlefront.com does not offer refunds for products purchased. 

    I hereby speculate that BF does not offer refunds.

    Now you seem to think that this clause, in the federal law:

    "Section 435.3(b) of the final Rule continues to provide that the Commission does not intend to preempt action by state or local governments or supersede any provisions of any state or local laws, except to the extent that they conflict with the Rule. A law does not conflict with the Rule if it affords buyers equal or greater protection."

    Means the opposite of what it states? You are claiming that the law allows state law to supersede federal law, but this clause explicitly states the opposite. Unless the state law also allows for a refund after a date has been missed, then the federal law is applicable.

    The release date is stipulated on the front page, but in a fashion that lawyers fantasize about: "The obvious question out there is "when will CMSF2 ship?" We're aiming for no later than the end of September."

    The actual purchase page only stipulates:

    "Combat Mission Shock Force 2 is in the final stages of development, however it is not yet ready for release"

    Seems pretty cut and dry to me. Hopefully you're not Steve's lawyer!

    Tell me friend - on what date would you consider an order placed for delivery by "the end of September" to be late?

    Do you consider the end of September to be a period; say, the 22nd to 31st? Or do you consider it to be the last day of the month, the 31st?

    [Edit: Apparently you consider the end of September to occur sometime in October.]

    Hilariously, in either case, Battlefront did not inform anyone of the date slippage, and, if they had, would not have extended a refund.

    What is your point? To continue to embarrass yourself?

    To anyone interested, this is why most businesses do not charge for a pre-order until the actual date (pledge systems such as GMT for instance), because (among other reasons) it successfully skirts this FTC regulation.

    However, once a transaction has occurred, a reasonable date must be supplied and, if not, then the FTC provision says 30 days is implicit.

    Exactly!  Prepayments are generally used to generate income for a business in advance of shipping. This allows the company to meet overheads, such as staff wages and prevent a cash flow problem arising. BF are not offering prepayment discount as a kind gesture - it benefits the company in its development of the product. How naive to think otherwise!

     "Suing" BF- doh!!  What contract law is effectively supporting is a buyers right to seek a refund from a seller if delivery of the goods within a reasonable period fails.

    I never thought I'd ever feel this way with BF, but I am very close myself to requesting refund on SF2, though not because of the delivery issue. It is in part because of BF's continuing failure to provide an update about the lapsed release window and being forced to check back in to find out what is going on, and having done so, I read yet more dismissive, intolerant and disrespectful responses (from the same defenders of BF) to the valid views and concerns expressed on this thread and elsewhere on the forum. 

    Worse, it doesn't help that they repeatedly misunderstand or demonstrate a lack of listening skills and reasoned thinking when compiling their responses. And whether BF like it or not, these members are perceived as representing the position of BF and speak with authority about the company. 

    If anything is badly needed going forward, it's that BF require a competent and strong communications person to represent them, and then those members that are so disastrously filling the vacuum presently, can take a well-deserved back seat!

    It's not my concern that you don't care about proof, and I'm sure that you've studied up on American mercantile law. If you were as studious as you are obnoxious, you'd be ready to give me a real run for my money.

    Perhaps you're conflating understanding with doing - it is the case that this is the law, it is not the case that anyone is suing. Reading comprehension: it's great, try it out.

    Oh wow - threatened by no discount. Perhaps such a tiny company should be worried about customers purchasing their content, and their fragile customers should not be so worried about upsetting the big boss for fear of losing a discount. How did business become this sycophantic and servile?

    The biggest difference being that MMP don't actually charge until the product is ready to ship. Please research the facts before using something (inaccurately) to make a point about how BF operate! 

    I think I made it quite clear in my previous posts that when a company take your money they are entering into a legal contract to deliver the product and an approximate timescale for delivery forms a part of that bargain. This is why MMP do not take pre-order cash until ready to ship; there is no legally binding undertaking at that stage and the customer is free to cancel at any time. This is the reason why.

    Returning to your earlier post, this isn't about trolling Vet! I'm stating things to you as facts, I'm not inciting aggravated responses to my posts! 

    I'm all in favour of BF not offering release windows, but when they do this they cannot also ask customers to effect transactions until a shipping window is indicated. The offers around SF2 is the difference against (all as far as I am aware) previous CM products on this occasion.

    That's intentionally misleading. People are taking issue with no subsequent posts being made, not with the initial announcement, and not even with the date possibly slipping.

    My god - it is alarming to think that the message they might receive is to not post at all, rather than "post more than once".
